How to report copyright infringement on the KeyDir Application, and what happens after a takedown notice is received.

The KeyDir Platform hosts directory listings and user content, not user-uploaded media files. Copyright concerns most commonly involve product images, logos, and brand assets referenced in listings.

SECTION_01 Overview

KeyDir respects the intellectual property rights of others and expects the same of its users. If you believe that any material made available on the KeyDir Application infringes a copyright you own or control, you may file a takedown notice as described below.

This policy follows the general structure of the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, which creates a "safe harbor" for online services that respond expeditiously to valid infringement notices. Our procedures are intended to work with similar copyright frameworks worldwide.

SECTION_02 What the Platform Hosts

The platform is a directory of links and factual business information with user-generated content. It does not host vendor product files, videos, or software. A typical copyright concern is:

  • A product photograph copied into a listing without authorization.
  • A brand logo or artwork used without permission.
  • Copyrighted text or marketing material reproduced on a page.

If the infringing material is hosted on a third-party website that the platform merely links to, the appropriate action is to contact that website's host, not KeyDir. However, if a listing on the platform itself displays infringing material, we will act on a valid notice.

SECTION_03 Filing a Takedown Notice

To file a takedown notice, send a written communication to our designated contact at officialkeydir.in@gmail.com containing the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work(s) claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing, with enough detail for us to locate it (e.g. the listing URL and the specific image or text).
  4. Your contact information — name, address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Misrepresentation. Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing may be liable for damages. Only file a notice if you are confident you have the rights described.

Upon receiving a complete and valid notice, we will investigate and, if appropriate, remove or disable access to the identified material expeditiously and notify the affected party.

SECTION_04 Counter-Notification

If your material was removed due to a takedown notice and you believe it was removed in error or misidentified, you may submit a counter-notification containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and where it previously appeared.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement consenting to the jurisdiction of the courts of the jurisdiction in which the platform operates, and that you will accept service of process from the party who filed the original notice (or their agent).

Upon a valid counter-notification, the material may be restored in accordance with the applicable law.

SECTION_05 Repeat Infringers

We maintain a policy of terminating, in appropriate circumstances, users who are determined to be repeat infringers of copyright.

SECTION_06 Misuse & Bad-Faith Notices

We take abusive or bad-faith notices seriously. Filing a knowingly false notice can result in legal liability for the filer. Additionally, we may take action against anyone who files abusive notices to harass KeyDir, its operators, or listed businesses.

SECTION_07 Other Jurisdictions

The DMCA is a United States law. If your dispute is governed by another jurisdiction's copyright law (for example India's Copyright Act, 1957), a DMCA notice may still be the practical mechanism to contact us, but local procedures may differ — consult a qualified professional if you are unsure.

Regardless of jurisdiction, we aim to respond promptly and fairly to clear, good-faith copyright concerns. Where a notice is not in the required format, we will make reasonable efforts to contact the sender to resolve the deficiency.
